A LEGAL DISCLAIMER

Inherent Risks: Participation in gymnastics activities involves inherent risks, including but not limited to the risk of physical injury or death. By using our services, you acknowledge and voluntarily assume all risks associated with participation in gymnastics activities at John's Academy of Gymnastics ("JAG").

Release of Liability: To the fullest extent permitted by law, you agree to release, waive, discharge, and covenant not to sue John's Academy of Gymnastics, its owners, employees, instructors, agents, and affiliates from any and all liability, claims, demands, actions, and causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained while participating in activities at JAG, whether caused by the negligence of JAG or otherwise.

Medical Emergency Authorization: In the event of a medical emergency, you authorize JAG staff to seek emergency medical treatment. You agree to be financially responsible for any medical treatment costs.

Health Representation: By enrolling in classes or activities, you represent that you (or your child) are in good health and have no medical conditions that would prevent safe participation in gymnastics activities. You agree to inform JAG staff of any changes to health status that may affect participation.

Required Waivers: All participants (or their parent/legal guardian if under 18) must sign a separate facility waiver and release form before participating in any JAG activities.

Media Release: By participating in JAG programs, you grant JAG the right to use photographs, videos, or other media of you or your child for promotional purposes on our website, social media, printed materials, and other marketing channels without compensation. Written notification is required if you do not wish to grant this permission.

Disclaimer of Warranties: This website and JAG services are provided on an "as is" and "as available" basis. JAG makes no representations or warranties of any kind, express or implied, regarding the operation of the Site, the accuracy of information provided, or the results of participation in our programs.

Limitation of Liability: To the fullest extent permitted by law, JAG shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of this Site or participation in JAG activities. In no event shall JAG's total liability exceed the amount paid by you for accessing the Site or participating in JAG programs.

TERMS & CONDITIONS

Acceptance of Terms: By accessing or using the John's Academy of Gymnastics website (jagymnastics.org or jaggym.com) or participating in our programs, you agree to be bound by these Terms and Conditions. If you do not agree, please do not use our Site or services. We reserve the right to modify these Terms at any time, effective immediately upon posting.

Permitted Use: You may use this Site for lawful purposes only. You may not use the Site in any way that violates applicable laws, infringes on the rights of others, or transmits harmful or unauthorized content.

Intellectual Property: All content on this Site, including text, graphics, logos, images, videos, and software, is the property of John's Academy of Gymnastics and is protected by copyright laws. You may not reproduce, distribute, or modify any content without our express written permission.

User Accounts: If you create an account for class registration, you agree to provide accurate information and maintain the confidentiality of your credentials. You are responsible for all activities under your account. We reserve the right to suspend or terminate accounts at any time.

Class Registration & Payment:

  • All registrations are subject to availability

  • Payment is due at time of registration unless otherwise specified

  • All prices are in U.S. dollars

  • We reserve the right to cancel or reschedule classes

  • Pro-rated enrollment is available for students joining mid-session

  • Refunds and cancellations are subject to our separate Refund Policy (available upon request)

Code of Conduct: All participants and parents/guardians are expected to conduct themselves respectfully. JAG reserves the right to remove any participant or terminate enrollment without refund for disruptive, disrespectful, unsafe behavior, or violation of facility rules.

Privacy: Your personal information is handled in accordance with our Privacy Policy. Any medical or health information provided will be kept confidential and used only for program safety and administration.

Third-Party Links: This Site may contain links to third-party websites. JAG is not responsible for the content, privacy policies, or practices of any third-party sites.

Indemnification: You agree to defend, indemnify, and hold harmless JAG and its affiliates from any claims, liabilities, damages, losses, and expenses arising from your use of the Site, violation of these Terms, or participation in JAG activities.

Governing Law: These Terms shall be governed by the laws of the State of Connecticut. Any disputes shall be resolved in the state or federal courts located in New Haven County, Connecticut, or through binding arbitration where applicable.

Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

Entire Agreement: These Terms, together with our Privacy Policy and facility waivers, constitute the entire agreement between you and JAG regarding your use of the Site and participation in our programs.

BY USING THIS WEBSITE AND/OR PARTICIPATING IN JOHN'S ACADEMY OF GYMNASTICS PROGRAMS, YOU ACKNOWLEDGE THAT YOU HAVE READ AND UNDERSTOOD THIS LEGAL DISCLAIMER AND TERMS AND CONDITIONS, AND YOU AGREE TO BE BOUND BY ALL PROVISIONS CONTAINED HEREIN.

YOU SPECIFICALLY ACKNOWLEDGE THAT:

  • You understand the inherent risks involved in gymnastics activities

  • You voluntarily assume all such risks

  • You release JAG from all liability as described above

  • You have been given the opportunity to ask questions about these Terms

  • You agree to abide by all facility rules and policies

If you are enrolling a minor child, you certify that you are the parent or legal guardian with authority to agree to these Terms on behalf of the minor.
